La reforma de l'Estatut d'Autonomia de Catalunya planteja dubtes sobre la noció de drets històrics i la seva aplicació a Catalunya. S'estudia aquesta qüestió, amb un anàlisi del contingut material del dret vigent a Catalunya al llarg de la seva història i reflexionant sobre el significat de la figura jurídica dels drets històrics dins el marc formal de la vigent Constitució espanyola de 1978 ​
