Abstract

L'exposició defensa un estàndard probatori general de "prova preponderant" per a la determinació dels fets en matèria de sancions administratives. Per a això analitza la distribució de riscos d'error que ofereix aquest i un altre estàndard i defensa una específica distribució d'ells, coherent amb les finalitats del dret administratiu

The exposition defends the application of the standard “preponderance of the evidence” to the determination of facts on the field of administrative sanctions. For this purpouse, it analyzes the distribution of the risks of error offered by two types of standard and defends a specific distribution of them according with the aims of administrative law
