Análisis económico de los estándares de prueba en el proceso-contencioso administrativo

Abstract

L’àmbit econòmic del dret presenta un subàmbit com són l’anàlisi econòmic dels estàndards de prova, els problemes relatius a la prova. Podríem dir que les regles i les normes jurídiques, en funció de la seva configuració, aconseguiran incrementar o disminuir el benestar de les persones. Establir estàndards de conducta molt exigents reduirà els incentius per a complir la normativa; si, pel contrari, establim estàndards de consulta poc exigents podem acabar condemnant a tothom. La regla processal, estàndard de prova, pot tenir conseqüències molt importants en l’acompliment de les normes

The economic field of law presents a sub-scope such as the economic analysis of test standards, problems related to testing. We could say that legal rules and norms, depending on their configuration, will manage to increase or decrease the well-being of people. Setting very demanding standards of conduct will reduce incentives to comply with regulations; If, on the other hand, we set undemanding standards of consultation, we can end up condemning everyone. The procedural rule, standard of proof, can have very important consequences on the performance of the rules
