El jutge intel·lectualment honest s'enfronta a un problema molt greu del qual s'ha parlat poc. A partir dels debats emergents de la teoria moral, anomeno aquest problema el problema de la "incertesa normativa". Sovint es passa per alt perquè la resposta habitual és que el jutge només hauria d'empassar els seus dubtes i fer el que cregui correcte. Però aquesta solució òbvia resulta equivocada. De vegades, no hauria de seguir la seva jurisprudència preferida, sinó fer el que suggereix una jurisprudència diferent
The intellectually honest judge faces a very serious problem about which little has been said. Drawing on emerging debates in moral theory, I call this problem the problem of “normative uncertainty.” It is often overlooked because the common answer is that the judge should just swallow her doubts and do what she thinks is right. But that obvious solution turns out to be wrong. Sometimes, she should not follow her preferred jurisprudence, but do what a different jurisprudence suggests instead
