Excepciones en las normas jurídicas. Una propuesta de análisis

Abstract

L'exposició justifica que la noció d'excepció no permet entendre ni identificar ni un element de l'antecedent de les normes ni un tipus de norma. La millor manera d'entendre com els teòrics del dret usen la noció d'excepció és com un concepte que refereix proposicions que descriuen el resultat d'un conjunt d'operacions d'o bé soscavar una norma (determinen que és irrellevant), o bé superar una norma ( determinen que el seu incompliment està justificat).

The exposition justifies that the notion of exception does not allow us to understand or identify an element of the antecedent of the norms or a type of norm. The best way to understand how legal theorists use the notion of exception is as a concept that refers to propositions that describe the result of a set of operations of either undermining a norm (determining it to be irrelevant), or overruling a norm (they determine that their noncompliance is justified).
