Abstract

Normes de competència com a normes constitutives – al·ludint a von Wright i altre, referents sobre el tema --, aspectes que els dos autors teoritzen sobre regles determinatives o regles constitutives, regular noves formes de conducte que les regles constitueixen. La teoria analítica del dret ha procurat mostrar la importància d’aquesta distinció i ha posat especial èmfasi en les normes de competència; això no ha estat sempre així però podríem dir que, ara, és una postura dominant. Norms of competence as constitutive norms – alluding to von Wright and others, referring to the subject --, aspects that both authors theorize about determinative rules or constitutive rules, regulate new forms of conduct that rules constitute. The analytical theory of law has sought to show the importance of this distinction and has placed special emphasis on competition norms; This has not always been the case but we could say that, now, it is a dominant position.
